Die EU plant offenbar eine Zwangsverschrottung von Oldtimern und alten Gebrauchtwagen und damit quasi eine Enteignung der Besitzer. Gibt es da wirklich etwas dran? Die Antwort zu geben ist gar nicht so einfach. Zumindest für Oldtimer-Besitzer gibt es jedoch Entwarnung.

Vor kurzem geriet die Oldtimer-Gemeinde in Deutschland in Unruhe. Berichte verbreiteten sich, dass die EU eine Richtlinie in Erwägung zieht, wonach Autofahrer möglicherweise dazu gezwungen werden könnten, ihr Fahrzeug zu verschrotten. Schnell wurden erste YouTube-Videos gedrehtartikel, dieser eine Enteignung der Autobesitzer in Aussicht stellte, verfasst. FOCUS online untersucht, ob und inwiefern diese Befürchtung zutreffend sein könnte.

Altauto-Verordnung: Keine Enteignung geplant

Es ist zunächst wichtig, den Inhalt des Vorschlags der Europäischen Kommission für eine “Verordnung des Europäischen Parlamentes und des Rates” vom 13.07.2023 genauer zu betrachten. Es ist entscheidend zu beachten, dass es sich hierbei lediglich um einen “Vorschlag” handelt. Dies bedeutet, dass die Inhalte keineswegs feststehen, sondern noch im Parlament und dem Rat diskutiert und mit den Mitgliedstaaten abgestimmt werden. Bereits bei der neuen Führerschein-Verordnung wurden nicht alle Verschärfungen umgesetzt, die in diesem Fall von einer Grünen-Politikerin auf EU-Ebene gefordert wurden, wie hier zu lesen ist: Führerschein-Hammer.  

Der überarbeitete Vorschlag zur Altauto-Verordnung der EU verfolgt in erster Linie das Ziel, die Klimaziele zu erreichen und eine klimaneutrale und saubere Kreislaufwirtschaft bis 2050 zu schaffen. Dies beinhaltet die Optimierung des Ressourcenmanagements und die Minimierung der Umweltverschmutzung.

Brüssel zielt darauf ab, die Klimaziele der EU zu erfüllen, indem es vor allem bei den jährlich sechs Millionen Fahrzeugen, die das Ende ihres Lebenszyklus erreichen, Maßnahmen zur Verbesserung der Umweltleistung ergriffen werden. Des Weiteren soll durch verstärktes Recycling von Materialien einerseits die Emissionen bei der Neuproduktion verringert und andererseits die Abhängigkeit von ausländischen Rohstofflieferungen reduziert werden.

„Kreislaufwirtschaft“ fördert umfassende Wiederverwertung alter Teile

Es ist keine Rede von einer Enteignung, die mit einer Zwangsverschrottung einhergeht. Dies bestätigt auch der CDU-Bundestagsabgeordnete Carsten Müller, der im “Arbeitskreis Automobiles Kulturgut” des Bundestags tätig ist. Müller betont, dass historische Fahrzeuge bewusst von dem Anwendungsbereich der Verordnung ausgeschlossen wurden, was bedeutet, dass die im Netz kursierenden Behauptungen, Oldtimer würden zwangsweise verschrottet, als “Fake News” zu betrachten sind.

Besitzer von Oldtimern brauchen sich daher nicht zu beunruhigen. Die vorgeschlagenen Regeln sollen zunächst für Pkw gelten und dann schrittweise auf Busse, Lastwagen und Motorräder ausgeweitet werden. Ein EU-Sprecher betont ebenfalls gegenüber der deutschen Presseagentur (dpa), dass Fahrzeuge von historischem Interesse explizit von den Vorschlägen ausgenommen sind.

Als historisches Fahrzeug (Oldtimer) gilt ein Fahrzeug, das mindestens 30 Jahre alt ist. Allerdings sind bestimmte Kriterien wie der Zustand und die Originalität des Wagens für die Zulassung des begehrten H-Kennzeichens, das den Oldtimer-Status garantiert, zu erfüllen.

 

Bestandsschutz für Oldtimer

Oldtimer dürfen nicht in ihrer ursprünglichen Form reproduziert werden und müssen weitgehend dem Originalzustand entsprechen sowie gut erhalten sein. Nicht jedes alte Auto erlangt automatisch den Oldtimer-Status. Es kommt auch vor, dass Fahrzeuge, die einen Totalschaden erlitten haben, repariert und ins Ausland verkauft werden, um den Vorschriften zur umweltverträglichen Entsorgung von Altfahrzeugen zu umgehen. Die Einhaltung dieser Vorschriften erfordert finanzielle Mittel.

And there is certainly a need to be cautious, especially in the context that the EU is known to phase out the internal combustion engine and only wants electric cars on the roads – with the ban on the registration of all internal combustion engines as the first major step by 2035. This means that there are indeed efforts in the EU, especially by green politicians and associated NGOs such as the German Environmental Aid (DUH), to drive the so-called “drive revolution” with significantly more pressure and bans, beyond what is already happening.

The best example is the diesel driving bans enforced by the DUH – the effect of which was so dubious that many cities have already revoked them, but they have led to a significant depreciation of millions of diesel cars.

Pre-owned car drivers should closely follow EU discussion

So, it can certainly not hurt to follow the increasingly abundant reforms emanating from Brussels with a certain skepticism. Because once guidelines are established and implemented into national law, it is too late for criticism. The CDU parliamentarian Müller also sees the need for further discussion on the proposed rules: “The definition of historic vehicles in the draft regulation is still too narrow. For example, regulations on spare parts and bureaucratic hurdles contained in it also need to be revised,” says Müller.

First and foremost: Many of the criteria by which a pre-owned car is defined as junk are obvious and were already in place. For example, if the “vehicle has been disassembled or scavenged”. Or if it has been burned to such an extent that the engine compartment or passenger compartment is destroyed. Such damages, which are listed in the annex of the mentioned proposals, are quite clear.

When must a pre-owned car be scrapped?

It becomes more interesting when it comes to the point “it has been welded or sealed with insulating foam”, which allows for more room for interpretation. In part B of the annex, the EU commissioners have put together a “preliminary criteria catalog for end-of-life vehicles” on paper, in which “additional factors are used to determine whether a used vehicle is considered an end-of-life vehicle.”

Point c is fascinating: “It has not been subjected to national technical inspection for more than two years since it was last required” That means, as soon as the TÜV (MOT) has expired, things can get tight for the vintage car as well as the pre-owned car owner.

Strive for efficient recycling

From the passages quoted at the beginning, it becomes clear that the proposals are primarily about the recovery of important raw materials. After all, Europe wants to become as independent as possible from raw material imports from abroad. In order to be as efficient as possible in recycling, this aspect should be taken into account already in the construction of the car, by the manufacturer providing precise instructions for dismantling the car and how individual parts can be replaced.

It is quite possible that this will also facilitate repairs and the procurement of spare parts. In this way, many drivers would even benefit from the regulations.At least there was recently a fairly consumer-friendly reform on the issue of genuine spare parts.

How cars could be better recycled

The European Commission is proposing the following measures for the implementation of the so-called “circular economy”:

  • “Circular design”: design and production oriented towards the circular economy;
  • “Recycled content”: increasing the recycled content in new vehicles;
  • “Higher collection rate”: increasing the collection rate for end-of-life vehicles in the EU and improving the quality of exported used vehicles;
  • “Extended producer responsibility”: creating incentives to increase collection rates for end-of-life vehicles and to improve waste treatment through an extended producer responsibility regime;
  • “Application to more vehicles”: expanding the scope of the legislation to cover additional vehicle classes.

Conclusion

The discussions surrounding the new end-of-life vehicle regulation have been intense – and in fact, a final judgment cannot be made yet because the legislative process is still in the voting process. However, the following points can be made now:

  • The statement that the EU is planning “mandatory scrapping” cannot be supported by the current proposals.
  • The proposed reform explicitly does not cover vintage cars as the European Commission also recognizes the historical significance of these vehicles. However, certain conditions must be met for a car to officially obtain classic status, just as is the case with current legislation.
  • It is conceivable that with ever-increasing regulations, owners of used cars may find it more difficult to keep their vehicles running with repairs, as they may be declared “non-repairable” or environmentally damaging. Owners, as well as dealers and workshops, should closely monitor the ongoing legislative process in this regard.
